The defense of plastic surgeon Sergei Morozov, sentenced on June 15 to 3.5 years in prison for providing services that did not meet safety requirements, filed an appeal against the verdict of the Meshchansky District Court. The doctor’s lawyer on appeal, OneginGroup managing partner Olga Zinovieva, insists that the conclusions set out in the verdict do not correspond to the actual circumstances of the criminal case.

According to the investigation, in 2022, Sergei Morozov performed secondary rhinoplasty on the patient and, while taking a rib graft, damaged her lung, causing serious harm to her health. The operation was carried out at the Medlange clinic in Moscow. A case was initiated against the plastic surgeon under paragraph “c” of Part 2 of Art. 238 of the Criminal Code of the Russian Federation. Morozov did not admit guilt. On June 15, 2022, the court sentenced him to 3.5 years in a general regime correctional colony.

The appeal notes that the violation of safety rules, according to the court, lies only in the fact that Morozov performed the operation in a clinic that did not have a license to provide it in a 24-hour hospital setting, although the events occurred before the updated procedure for providing such medical care came into force.

According to Olga Zinovieva, the connection between the clinic’s lack of a stationary license and Morozov’s criminal intent during the operation is not confirmed by the case materials, and the court’s legal assessment of the circumstances and actions of the doctor is based on an erroneous interpretation of the current legislation in the field of licensing of medical activities, the implementation of medical activities, and also criminal law.

“The court’s statement in the verdict that the absence of a hospital license in itself indicates the provision of dangerous medical services is absurd, since the very fact that a clinic has a license to carry out the relevant type of activity does not guarantee the quality of medical services, nor does the fact of the absence of such a license does not automatically make the provision of services of poor quality. Admitting the opposite would mean the need to recognize any high-quality medical care provided by a licensed clinic, and to recognize as obviously unfounded any patient’s claims related to possible defects in medical care, based on the very fact that the clinic has a “correct” license,” the lawyer explained, emphasizing that these arguments were not examined by the first instance.

In addition, the defense is confident that the actions of Sergei Morozov were qualified under paragraph “c” of Part 2 of Art. 238 of the Criminal Code of the Russian Federation (provision of services that do not meet safety requirements, resulting in the infliction of grievous bodily harm through negligence) “intentionally with the aim of artificially increasing the period of criminal prosecution,” since according to Part 2 of Art. 118 of the Criminal Code of the Russian Federation (infliction of grievous bodily harm committed through negligence as a result of improper performance by a person of his professional duties) the period for holding him accountable has expired.
